Terms and Conditions

Version 1.0, effective from 1 October 2026

These terms are the contract between you and us when you use komrce.eu. You accept them when you create your account or buy a place in a cohort. If you don't agree with them, please don't use the service.

1. Who we are

Komrce is provided by Pan Development SRL, registered office at Prelungirea Fieni 1B/3B, room 4, Balotești, Ilfov County, Romania, Trade Register no. J23/1497/2022, tax ID 30901735.

2. What Komrce is

Komrce is an eCommerce business simulation used for training, education and team building. Participants run a fictional online store, alone or in teams, and make pricing, stock, marketing and financing decisions that the simulation evaluates round by round.

The service comes in three forms:

The free demo, which you play on your own with your account.
Cohorts: scheduled, paid sessions led by a facilitator. The date, duration, language, price and minimum number of participants are shown on each cohort's page.
Sessions for organisations (companies, universities, summer schools), based on a separate offer or contract. Where that contract says something different, it takes precedence over these terms. When the organisation sends us participant data, the contract also includes a data processing agreement (Art. 28 GDPR).

Komrce is an educational tool. In-game results come from a simplified model of reality. They are not financial, legal or investment advice and do not guarantee results in a real business.

3. Your account

You need an account confirmed by email. Unconfirmed accounts are deleted automatically after 7 days.
You can create an account from 16 years old. Places are bought by an adult or an organisation.
Your account details must be real. You use one account, only your own, and you don't share your password.
You are responsible for what happens in your account. If you suspect someone else has used it, change your password and write to us.
You can delete your account at any time from My account → Delete account. What happens to your data is explained in the Privacy Policy.

4. Fair play

You may not:

use bots, scripts or other automated means to play or to load the server;
exploit simulation bugs to get results you wouldn't get by playing normally (if you find a bug, tell us, it helps);
access other participants' accounts, teams or data;
use offensive, discriminatory or unlawful team names or messages;
copy, decompile or reproduce the simulation model.

If you break these rules we may void your results and suspend or close your account. For serious breaches, the price paid for that cohort is not refunded.

5. Prices and payment

Prices are in euro and are shown on the cohort page. Pan Development SRL does not charge VAT (it is not VAT-registered under Art. 316 of the Romanian Fiscal Code), so no VAT is added: the price shown is the final price. The code RO37438825 in the site footer is a VAT number for intra-EU transactions only (Art. 317), used with businesses in other EU countries.
Payment is by card, through Stripe, in full at registration. Organisations can also pay by bank transfer, against an invoice.
Promotional codes are applied at checkout. They cannot be exchanged for cash and cannot be combined unless stated otherwise.
Your place is confirmed once payment is received. You get the invoice by email.

6. Right of withdrawal (consumers)

If you are a consumer (buying as an individual, not for a business), you may withdraw from the contract within 14 days of purchase, without giving a reason and at no cost, under Romanian Government Emergency Ordinance 34/2014 (implementing EU Directive 2011/83/EU).

How to withdraw. Before the 14 days are up, send us a clear statement that you are withdrawing. An email to imunteanu@komrce.eu is enough. You can use the withdrawal form in the Annex at the end of these terms, but you don't have to. What counts is the date you sent your message, not the date we read it.

Refund. We refund everything you paid within 14 days of receiving your message, using the same payment method unless we agree otherwise. The refund costs you nothing.

If the session takes place within the 14 days. At checkout we ask you to tick that (a) you expressly ask to attend the session before the withdrawal period ends and (b) you understand that you lose the right of withdrawal once the session has been fully delivered. In that case:

if you withdraw before the session starts, you get a full refund, however close to the session it is. The 50% rule in section 7 does not apply during the 14 days;
if you withdraw after the session has started but before it ends (for example, a multi-day session), you pay only for the part already delivered, in proportion to the session's length, and get the rest back;
once the session has been fully delivered, you can no longer withdraw.

Organisations (companies, universities and other buyers who are not consumers) have no right of withdrawal. Section 7 applies to them directly.

7. Cancellation, postponement and transfer

If you cancel outside the right of withdrawal (that is, after the 14 days in section 6 if you are a consumer, or at any time if you bought as an organisation):

at least 24 hours before the session starts: you get a full refund or a transfer to another date, your choice;
less than 24 hours before, or if you don't show up: you get 50% of the price back. Instead of the refund we may suggest a transfer to another date; it only happens if you agree.

For organisations, the offer or contract may set different cancellation terms.

If the session doesn't take place (not enough participants, the facilitator can't run it, or any other reason on our side): you get a full refund or a transfer to another date, your choice. We will let you know by email as early as possible.

Refunds are not automatic. Write to us at imunteanu@komrce.eu and we will refund you within 14 days of your request, using the same payment method.

8. Intellectual property

The simulation, its calculation model, texts, graphics, case studies and the Komrce brand belong to us. You get a personal, non-transferable right to use them to take part in the game. You may not copy, resell or use them to build a competing product.

Your team names and decisions remain yours. You allow us to use them in the simulation and, anonymised, in statistics, case studies and materials about Komrce. We never publish your name without your consent.

9. Availability and liability

We do our best to keep the service running without interruption, but we can't guarantee it. We may pause the service for maintenance or updates, preferably outside scheduled sessions. If an outage on our side ruins a paid session, we will rerun it or refund you.

To the extent permitted by law, our liability for any damage related to the service is limited to the amount you paid us in the last 12 months. We are not liable for decisions you make outside the game based on simulation results. These limits don't apply where the law doesn't allow liability to be limited, for example for gross negligence or intent.

10. Suspension and closure

We may suspend or close your account if you breach these terms, use the service fraudulently or if the law requires it. We will tell you and give you the reason, unless the law doesn't allow us to.

11. Changes to these terms

We may change these terms. For important changes, we will notify you by email or in the app at least 15 days in advance. If you don't agree with the new version, you can delete your account. A cohort you have already paid for runs under the terms in force when you paid.

12. Governing law and disputes

These terms are governed by Romanian law. We first try to settle any issue amicably: write to us at imunteanu@komrce.eu.

As a consumer, you can also contact the Romanian consumer protection authority (ANPC, anpc.ro) or use alternative dispute resolution (ADR) through the ANPC platform at reclamatiisal.anpc.ro. Disputes that can't be settled amicably go to the competent Romanian courts. If you live in another EU country, you keep the protection of the mandatory consumer law of your country and can also sue in the courts where you live.

13. Language

These terms are published in Romanian and English. If the versions differ, the Romanian version prevails.
